Surrogacy in Colombia

Colombia Program

A more accessible path to parenthood, without compromising on professional care.

Our Colombia Program is designed for intended parents seeking a more cost-effective surrogacy option while still benefiting from experienced fertility professionals and established surrogacy organizations.

The program is particularly well suited to independent intended parents who are comfortable pursuing an international journey and for whom budget is an important consideration.

The journey is divided into two main phases: embryo creation and surrogacy.

Phase 02
Your Surrogacy Journey
Phase
01

Creating Your Embryos

Embryo creation can take place either in Colombia with a local fertility clinic or in the United States, depending on your individual circumstances, preferences, and budget.

For intended parents choosing to create embryos in Colombia, one important consideration is the country's approach to egg donation and donor anonymity.

Egg donation in Colombia is anonymous. Intended parents generally receive limited non-identifying information about their donor, primarily relating to physical characteristics such as hair color, eye color, skin tone, and other general phenotypic characteristics. They should therefore be comfortable proceeding without the extensive donor profiles and photographs commonly available through donor programs in the United States.

Some Colombian clinics may offer AI-generated representations as part of the donor-selection process. This remains a sensitive area because donor anonymity must be preserved, and any information or representation provided must remain consistent with the applicable requirements regarding donor identity.

For intended parents who would prefer greater choice and information when selecting an egg donor, creating embryos in the United States and subsequently coordinating their transportation to Colombia may be a more suitable alternative.

U.S. donor programs generally provide access to much more comprehensive donor profiles. Intended parents may be able to view childhood and adult photographs and review extensive information about the donor, including her personal and family medical history, genetic screening, education, interests and hobbies, personality and personal preferences, as well as information about previous egg donation cycles and their outcomes when available.

This greater level of information allows intended parents to be more actively involved in selecting their donor and, for many families, provides an additional sense of confidence and peace of mind throughout the embryo-creation process.

Once the embryos have been created in the United States, HeraKin can coordinate their cryotransportation to Colombia, where the surrogacy phase of the journey can then take place.

Your Surrogacy Journey in Colombia

Once embryos are available, the surrogacy portion of the journey takes place in Colombia, where we coordinate with experienced local fertility clinics and qualified surrogacy foundations.

Ethical and Transparent Surrogacy in Colombia

At HeraKin, we have developed a trusted network of local surrogacy foundations in Colombia that share our standards for ethical, transparent, and professionally managed surrogacy journeys.

The well-being of the surrogate is fundamental to the way we work. We collaborate only with organizations that carefully screen their candidates and seek to ensure that surrogates enter the process from stable socioeconomic circumstances, with an appropriate support system and a clear understanding of the commitment they are making.

Throughout the journey, surrogates should be treated with dignity and respect, have access to appropriate private healthcare and professional support, and be able to develop open communication and a genuine relationship with the intended parents when both parties are comfortable doing so.

For HeraKin, ethics and transparency are non-negotiable. We carefully select the Colombian professionals and organizations with whom we collaborate and work only with those whose practices meet our standards.

Our objective is to bring to our Colombian programs many of the principles we value in well-managed U.S. surrogacy journeys: careful screening, transparency, informed decision-making, professional oversight, respect for the surrogate, and meaningful communication between everyone involved.

Throughout the process, HeraKin helps coordinate the different professionals involved, manage communication and timelines, anticipate potential challenges, and provide ongoing guidance from the beginning of the journey through pregnancy, birth, and the final steps required to return home with your baby.

Because a successful surrogacy journey should never be measured solely by its outcome. How that journey is conducted matters just as much.

Important Legal Considerations

Legal Framework

Colombia does not currently have a specific statute comprehensively regulating surrogacy. However, surrogacy is practiced in the country within a legal environment shaped by Colombian constitutional law and Constitutional Court jurisprudence. Because the regulatory framework continues to evolve, careful legal planning is an essential part of every Colombian surrogacy journey. HeraKin works with experienced local professionals to ensure that intended parents understand the legal process, parentage requirements, documentation, and international considerations before beginning their journey. Birth Certificate

Under the legal framework currently used in most Colombian surrogacy arrangements, the surrogate is generally listed on the birth certificate together with the biological (genetic) parent. Consequently, only the genetic parent is initially recognized as the legal parent at birth. One important advantage of this approach is that families are usually able to leave Colombia more quickly because no court process is required before obtaining the baby’s documentation. The expected stay after delivery is generally 2 to 3 weeks, although timelines vary depending on each family’s circumstances and the applicable consular procedures.

Recognition of the Second Parent

The intended parent who is not genetically related to the child will generally need to complete a second parent adoption or equivalent legal recognition procedure after returning home. Likewise, an additional legal process will typically be required in the family’s home jurisdiction to establish full legal parentage and, where applicable, remove the surrogate from the birth registration.

Possible Exceptions

Depending on the intended parents’ nationality and country of residence, it may be possible for both intended parents to be listed directly on the birth certificate as Parent 1 and Parent 2, without naming the surrogate. However, this possibility is not universally available and must be evaluated individually based on the laws of the relevant jurisdictions.

Recommendation

At HeraKin, we believe that understanding the legal implications of an international surrogacy journey should happen before the journey begins, not after the baby is born. Before moving forward with a surrogacy program in Colombia, we will help connect you with a qualified attorney in your home country who can advise you on parentage, citizenship, immigration, and the process for returning home with your baby. This allows us to identify potential legal complications in advance and, most importantly, confirm that Colombia is a suitable option for your individual circumstances before you commit to the journey.
